Sept 20 Judge Ira A Abbott sitting as presid ing judge of the Second judicial district court this
morning announc ed that he had overruled the demurrers of the defendants in the cases of the United
States of America vs the American Lumber Company and Clark M Carr in which It was alleged that the
United States had X no right or title to the land having transferred it to the Territory and that as
the Territory was a sovereign body it could not be used except X by authorization of Congress or in
the United States Supreme Court Judge Abbott holds that the Territory is merely a trustee for the X
lands and that the United States does not surrender the right to de X mand an accounting at any time
an d that the Territory is not a sover X X eign body
