10 THE EAULK WEDNESDAY JUNE 12 1895 IMPORTANT DECISION Solicitor General Victory Rentier an Opin ion us to Clerks of School ItonrdH Solicitor General Victory has rendered the following decision in reply to a letter from Supt Chaves I am in receipt of your letter dated May 31 in which yon request my oihVial opinion as to the legality of the appointment by boards of education in incorporated towns of one of their own members as secretary of the board on a salary Theaetcstablish ing such boards is found in the laws of 1891 page 138 and it seems plain to me that the whole phraseology of that act so far as it relates to the subject indi cates that the legislature intended the secretary to be a person not a member of the loard This is shown by section 15 in which it is expressly provided that the president and vice president shall lo elected from the members of the lward whereupon it is then provided that they the lward shall also elect a clerk who shall hold his office during the pleasure of the loard The imposi tion of a condiciΓ³n in the first instance and its omission
